How accurate must an indictment be when presented to a GRAND JURY?
If a count on an indictment presented to a Grand jury does not accurately describe the manner a crime is committed, can that count be thrown out later, even if the Grand jury provided a true bill on the commission of the crime.

Answer: A Grand jury is an investigative body that works in conjunction with the prosecutor's office to produce indictments of felony crimes for trial. The purpose of the Grand jury system is to assure that prosecutions are based on reasonable standards of evidence, and that prosecutors are bringing cases to the courts worth the expense and anguish of criminal trial.
A trial jury is selected to serve soley for a specific court case, and decides upon guilt or innocence, and in some capital cases, recommendations for sentencing. The trial jury is dismissed at the conclusion of the case.
The selection of a Grand jury varies slightly from jurisdicition to jurisdiction. Generally, a citizen who is interested in serving on the Grand jury can apply at the state court web site, or other administrative venue. In some states, the courts will send out applications randomly to citizens based on tax rolls, or state department of motor vehicle lists. A panel of judges nominates grand jurors from a list of applications received.
Spouses or relatives of court officials are generally disqualified.
The term of service is one year.

Answer: Yes. It's the same jury pool. Since Grand Juries can last longer than regular juries, they are requested to be available for a longer period. If someone has a problem with that, they are excused.

How long does it take a GRAND JURY to indict someone on a federal felony?
My friend goes before a Grand jury tomorrow for the first time to see if he can be indicted on a federal felony. He has been in a Knoxville, TN jail which I assume is a more populated area. So I suspect they meet more often than a less populated area. The charge is for transporting a minor across state lines for sexual purposes. Given that information, how soon can they decide on an indictment?

Answer: Grand jury panels are selected the same way petit, or trial, juries are. There is very little voir dire, which is done by the judge, and jurors are only excused for cause.
Grand jury proceedings are totally secret. The only people who can be present are the jury, a witness (while testifying), a sworn interpreter (if needed), the court reporter, a Grand jury clerk, and the prosecutor. It is unlawful for anyone else to be present, and it is unlawful for members of the jury or anyone else to discuss what takes place in the Grand jury proceedings.
Grand jury testimony is usually released prior to trial so that the defendant has a transcript of the proceedings in his or her case only.
Defendants do not have a "right" to testify at Grand jury, though they may be invited to testify if they wish to. They have an absolute fifth-amendment right not to testify. If they do choose to testify, they can consult with a lawyer outside the Grand jury room at any time, but the lawyer cannot be in the Grand jury room.
The Grand jury usually only hears one side of the case, and that is the State's side. The State would have an obligation to present any evidence tending to prove the defendant is not guilty. The reason it is one-sided is that the purpose of the Grand jury is only to ensure that the State has sufficient evidence to formally charge the defendant with a crime. It does not determine guilt or innocence, it only returns an indictment, or a "no bill" if there is insufficient evidence.

Answer: The 5th amendment basically, states that you do not have to incriminate yourself. So if you are on trial for something you do not have to testify, and say that you did it. The only way that is stipulated, is if you are on a trial, and the Grand jury has stated that indeed you do have to testify.

What does it mean if you have to appear before a GRAND JURY?
Basically, Im referring to the Kyron Horman case. At one point, the step mom had to appear before the Grand jury. Later, it was her friend. Then it was the bio mom and the bio dad and I think the step dad all at the same time. Some of my facts/terminology might be off. Answer: Generally, if a prosecutor is unsure whether he or she has probable cause to arrest an individual on suspicion of a particular crime, the prosecutor may present the facts and testimony of the case to a Grand jury, which is empaneled much like a regular jury. Typically, only the prosecution presents evidence to the Grand jury; however, the potential suspect may appear with his/her attorney and make a statement of their own.
There are also investigative grand juries, which request that the prosecuting attorney summon witnesses that the Grand jury wishes to hear from so that they may determine whether someone should be charged with a crime.
Grand juries are typically larger than trial juries (18, rather than 7 or 12 members) and often operate largely in secret. They are only used in criminal (not civil) cases.

I got summoned for Grand jury duty in New York City. I am planning a trip around that time and I am wondering how long it takes? Has any one done this? I have read in different places that you serve only for a 4 week "term of court". Is this true?
Answer: Grand Juries have a whole different set of rules than others. A grand juror serves for how ever long the jury determines is necessary to handle the matters at hand. The point of a Grand jury, in New York law, is to make certain that someone charged with a capital offense should really be charged! (In medieval times the King would just say, "Off with their head" or "put them in the stocks" or something else on a whim. A Grand jury was a citizen body created to insure that real wrongs were done, not just a ruling elite setting arbitrary punishments.)
This is from the NY state law: "A grand juror shall serve for the duration of the term for which the grand juror has been selected and for any period during which the Grand jury panel on which the grand juror has been serving is extended, unless sooner discharged."
So, you'll serve for however long it takes to for you to be convinced that the accused is rightfully, or wrongfully accused.
