Isnt Oracle in violation of the Java copyleft license? Wasnt java an open source program protected under it?

Copyleft licenses require that information necessary for reproducing and modifying the software must be made available to recipients of the executable. The source code files will usually contain a copy of the license terms and acknowledge the author(s). Copyleft type licenses are a novel use of existing copyright law to ensure a work remains freely available. The GNU General Public License, originally written by Richard Stallman, was the first copyleft license to see extensive use, and continues to dominate the licensing of copylefted software. Creative Commons, a non-profit organization founded by Lawrence lessig, provides a similar license called ShareAlike. http://en.wikipedia.org/wiki/Copyleft So how can they sue Google when they are the ones in violation of the open source rules? How does "cultural nobility" impede creativity, communication, and community? Do you have any examples?

This question is based off of "Free Culture" by Lawrence lessig and I have to write an essay in response to that question but I am having trouble brainstorming what to write. Answer: The term derives from Latin nobilis (well-known, famous), indicating those who were "well-known" or "notable" in society, and was applied to the highest social class in pre-modern societies. In the feudal system (in Europe and elsewhere), the nobility were generally those who held a fief, often land or office, under vassalage, i.e., in exchange for allegiance and various, mainly military, services to a suzerain, who might be a monarch or a higher-ranking nobleman. It rapidly came to be seen as a hereditary caste, sometimes associated with a right to bear a hereditary title and, for example in pre-revolutionary France, enjoying fiscal and other privileges. While noble status formerly conferred significant privileges in most jurisdictions, today it is a largely honorary dignity in all nations, although a few, residual privileges may still be preserved legally (e.g. Netherlands, Spain, UK) and some Asian, Pacific and African sub-cultures may still attach considerable significance to formal, hereditary rank or titles. Nobility is a historical, social and often legal notion, differing from socio-economic status (or class) in that the latter is mainly based on income, possessions and/or lifestyle. Being wealthy or influential cannot, ipso facto, make one noble, nor are all nobles wealthy or influential (aristocratic families have lost their fortunes in various ways, and the concept of the 'poor nobleman' is almost as old as nobility itself). Although many societies have a privileged 'upper class' with substantial wealth and power, the status is not necessarily hereditary and does not entail a distinct legal status, nor differentiated forms of address. Various republics, including the United States, former Iron Curtain countries, Mexico, and Austria have expressly abolished the granting and/or use of titles of nobility to or by their citizens. This is distinct from countries which have not abolished the right to inherit (formerly) noble titles, but which do not grant legal recognition or protection to them, such as Germany, and Italy, although Germany recognizes their use as legal surnames. Lessig said [former federal counter-terrorism adviser Richard] Clarke told him that the Justice Department had already written up much of the Patriot Act before the terror attacks of September 11, 2001, and that there is a similar proposal on the shelf in case of an Internet catastrophe. Answer: I never thought I'd see someone ask about Lawrence lessig on YA. Firstly, code is one of three interconnected factors in the area of Intellectual Property - market, code and law. The Market represents the demand for IP - books, music and so on. Code represents physical or hardwired limitations on dealing with IP. Lessig views the law as a tool to correct imbalances between the market and code: Before the invention of the printing press, for example, code and the market was in balance. Demand for IP was insufficient (what with low levels of literacy) in relation to the limitations of code (having to copy material by hand) to make infringement of work a significant problem for authors. The law (in various forms) became necessary with widespread literacy (thus increasing demand in the market) and easier methods of copying (the press). However, code can also include measures taken to secure work from copying. Just as medieval monks could lock their books in a library, modern companies can encrypt their works, guard them with DRM systems etc - what Lessig calls "digital locks and chains". Because the law (in Lessig's view) exists to regulate the market in the absence of sufficient code, code can overtake law (i.e. the law becomes redundant when there is sufficient code to prevent the market demand leading to infringement. "The Code is Law" expresses the interrelation of code and the law, and the potential of the code to supplant the law's functions in balancing the market to prevent economic market failure (due to too much infringement). btw, Lessig's Code v2 is availible free online in .pdf format, and makes an interesting read.

Creative Commons an alternative to Net Neutrality?

Could Lawrence lessigs Creative Commons become an alternative form of Net Neutrality? I once considered myself to be a supporter of Net Neutrality until I discovered the world of Creative Commons. I feel that Creative Commons is a way to keep the internet an open democracy without placing regulations like Net Neutrality does. Creative Commons if expanded on the same level as Net Neutrality, could do some of the same things that Net Neutrality sets out to do, such as make any page on the internet accessible to anyone, anywhere, for free. No rule book needed, just a small "cc" logo on the page, "some" rights reserved. Any input would be greatly accepted thanks, J
Answer: Net Neutrality is important because it allows us free unrestricted access to the internet. There is nothing wrong with the internet, I can't help it that ISPs need money for building up their backbone networks. Neither can Google and the millions of other websites. If ISPs like many business lately would have managed their money more wisely then they would not be in this mess. I haven't been keeping up on the subject of Net Neutrality so I haven't heard about Creative Commons. A small CC logo seems like at a foot in the door to me.
