WASHINGTON, D.C. – A federal court today ruled that former Rep. Steve Driehaus’s defamation lawsuit, alleging that the Susan B. Anthony List cost him his job and a “loss of livelihood” by educating constituents about his vote in favor of taxpayer funding of abortion in the health care bill, should go to trial. The court also dismissed a challenge by the Susan B. Anthony List to Ohio’s False Statement law which empowers state officials to enforce stiff fines—even prison time—for criticism of candidates that they deem to be “false.”
“No politician, bureaucracy, or court should have the power to silence the right of citizens to criticize elected officials,” said Marjorie Dannenfelser, President of SBA List. “Ohio’s False Statement Law allows candidates like Steve Driehaus to silence any speech critical of them by simply filing a complaint with the Ohio Elections Commission. Then, when the election is over, the candidates can dismiss their complaint so the law cannot be reviewed by the federal courts. An unelected commission should not have the ability to decide what is true and false speech, nor tell us what speech we can and cannot hear.”
Since Driehaus filed his suit last year, SBA List’s arguments have gained widespread acceptance. The ACLU of Ohio, in an amicus brief filed last October, came to the groups defense, declaring unequivocally, “The people have an absolute right to criticize their public officials, the government should not be the arbiter of true or false speech, and the best answer for bad speech is more speech.” The lawyer who wrote the brief is an abortion rights advocate.
“Steve Driehaus’ constituents saw the truth about his pro-abortion record and made their voices heard on Election Day,” said Dannenfelser. “Their conclusion – that Steve Driehaus voted for a bill allowing taxpayer funding of abortion – is backed by every major pro-life organization in the country along with the United States Conference of Catholic Bishops, the Congressional Research Service and other nonpartisan organizations. The SBA List will continue to defend its actions, the voters and the right to criticize our elected officials.”
“The SBA List’s speech was true, or at the very least it was its protected opinion about the meaning of Obamacare,” said James Bopp, Jr. counsel for SBA List. “Yet the court found that the SBA List’s speech about Driehaus might be defamatory and ordered a trial to determine whether it is or not. In a Supreme Court case called NY Times v. Sullivan, the Court established special rules for the type of speech that can be considered defamatory of public figures like elected officials. In order to be defamatory, the speech must obviously be false and cause injury, but it must also be made with actual malice. That’s a legal term that means that the speaker either knew the speech was false and said it anyway, or the speaker recklessly disregarded finding out whether the speech was true or false. That plainly was not the case with the SBA List. They researched Obamacare themselves, and they also read the opinions of other groups that also concluded that Obamacare provided taxpayer funds for abortion services. Yet this court found, in spite of that, and in spite of the fact that their speech is true or at least their protected opinion, that their speech might be defamatory. This ruling means that anybody criticizing a candidate is in danger of a defamation claim.”

Answer: It is not only if what they said is false, it is how they said it. For example if they exaggerated anything, like calling him a baby killer and the like. That is not presented here, yea, or nay. I also did not see anything saying if SBA would be classified as a political related group and required to follow under the FEC rules or the Ohio equivalent, which it sounds like it does. Groups that are not political in nature would not be under their jurisdiction. Also the law is obviously not saying that they deem to be false, they have to prove it is false. For all this, I cannot make a judgement either way on this. z

What about the pope? My understanding is that the pontiff usually takes a dump in the woods. I dont know why that would be. The Vatican seems like it would have top notch facilities, especially for the pope. And maybe a mini-fridge stocked with box after box of wine and those crackers they give out as snacks. I also figured the vatican might have their own brand of toilet paper, like Steve Jobs and the President have. Some 3 ply action. Maybe even 4. With little bible verses on it. Is it true that I have a horrible lifestyle schoolwise?
I think my school has low expectations for me. Half of my classes are special ed, and never this entire school year was I assigned more than a worksheet or two for homework. In my school district, if I was in regular ed, Id be getting 10 minutes of homework for every grade year Im in. For example, 1st grade gets 10 minutes, 2nd grade gets 20 minutes, and so on. Ive been getting much less than that all my life.
Also, every time I have a quiz in Geometry, my assistant teacher takes me two classrooms down the corridor to take the quiz in privacy. Last Friday I had a quiz in Geometry, and although I spent 30 minutes studying for it, it took me over an hour just to complete it. And I asked the assistant teacher for a hint 4-6 times. A good test taker should NEVER ask the teacher for any hints at all. Not even one. Regardless of grade.
The reason why the teachers expectations on me are a fraction of an average high school sophomore is because back in elementary and middle school, Ive fought the teachers and was very resistant to directions back then. I am also held back a year.
Here are my grades, and the reason for them, as discussed with my special ed teacher:
Math: C
Reason: Until recently, I never studied for the tests and quizzes.
Reading: C
Reason: I hate fiction. I do much better with nonfiction. If a teacher gives me a book about boys stranded on an island, I cant wait until it ends. On the other hand, if its a book about New York City or Washington, D.C., which are my two favorite cities, I jump straight into the action!
Concert Band: A
Reason: This is the only class I show positive attitude in. Its the only class thats with my interests.
Social Skills: A
Reason: They cut me a lot of slack in that class. I have autism.
Another point. My school district has required summer reading for any student entering grades 7-12 following summer vacation. I am one of the very few people in the school district exempt from that. The Special Education Department believes Ill be too pressured if they assigned me this the same way the regular students are.
My lifelong goal that I hope to achieve 20 years from now is to get into a college that all the people who want to make six-figure go to, like Notre Dame or NYU, get a six-figure job in NYC, like maybe Apple, Inc. (yes, I do miss Steve Jobs), and build my own 3-story, 5,000 square foot house in a walkable NYC suburb, like Ridgewood, New Jersey.
In case youre wondering about extracurricular activities, Ive never been in an extracurricular activity. That only adds another reason why my theres not a lot of smiling when I show people my report card.
Im in 10th grade, and I set a shorter goal, to get into an AP course by my junior year. Its unlikely Im going to make that. Unlike the regular courses, the College Board is legally authorized to deny you from being in it if the grades on your record arent to their liking. There is no special way to get into these courses. I have autism, but sadly, the College Board could care less about that. The admissions guys are just going to say "Because Thomas fails to exhibit excellence in his regular ed courses, what reason do we have to believe hell excel in an AP class? Clearly his grades indicate he is incompetent to be in this type of rigorous education." Im taking every chance I have to get into an AP class. Itll make your college experience unparalleled to the people who didnt take an AP class while they were still in high school!
My family says I am a very bright student, but I dont show the teachers what Im capable of.
Do you agree with me that my school has low expectations for me? Is there anything I should do about this?
Answer: ANY "Lifestyle" is Only As GOOD- as the Attitude of the Person IN it !! “The SBA List’s speech was true, or at the very least it was its protected opinion about the meaning of Obamacare,” said James Bopp, Jr. counsel for SBA List. “Yet the court found that the SBA List’s speech about Driehaus might be defamatory and ordered a trial to determine whether it is or not. In a Supreme Court case called NY Times v. Sullivan, the Court established special rules for the type of speech that can be considered defamatory of public figures like elected officials. In order to be defamatory, the speech must obviously be false and cause injury, but it must also be made with actual malice. That’s a legal term that means that the speaker either knew the speech was false and said it anyway, or the speaker recklessly disregarded finding out whether the speech was true or false. That plainly was not the case with the SBA List. They researched Obamacare themselves, and they also read the opinions of other groups that also concluded that Obamacare provided taxpayer funds for abortion services. Yet this court found, in spite of that, and in spite of the fact that their speech is true or at least their protected opinion, that their speech might be defamatory. This ruling means that anybody criticizing a candidate is in danger of a defamation claim.”

Answer: Elected public officials have always been held to a higher standard that the normal non elected citizen. But let the suit continue, all the way up to the Supreme court if necessary to reach resolution.
