Could you honestly picture the 9TH CIRCUIT COURT OF APPEALS giving gay marriage an UNFAVORABLE ruling?

I read an article that stated something along the lines of....
"Despite the 9ths circuits liberal reputation,

Answer: Doesn't matter. There are no LEGAL arguments against gay marriage. All the precedents are in its favor. The plaintiff's lawyer (Ted Olsen) is a Conservative who worked for Bush! Only a biased craven rubber stamper could vote against it -- which means the SCOTUS will be 5-4 for overturning Prop 8.

The 9TH CIRCUIT COURT OF APPEALS?
Can someone tell me why a lot of people call it the "The 9th ""Circus"" Court of Appeals"?
Answer: In part, the answer is because of it's large reversal rate. As compared to the rest of the circuits, the 9th's caseload is such that they often have to pull district court judges up to fill the panels as opposed to overloading the federal appeallate court judges. Consequently (or so the argument goes), the 9th Circuit opinions don't necessarily take into consideration larger issues, which creates splits among the circuits that create more work for everybody and require the US Supreme Court to resolve.
The problem, as is being discussed, is to split the 9th circuit into two circuits. Of course, doing this costs money, and Congress has other more pressing issues on its plate at the time being. Until such time, the "circus" remains.

Answer: Good question--but it can't really be answered without knowing on what grounds the court bases its decision and how broad its holding is. Other states' laws may be somewhat different, for example, and not subject to the same challenges as have been brought against the California provision. Most other states don't have any provision defining marriage as being between a man and a woman; so, the impact of such a decision might be unclear in those states.

Is it just me or do other folks think that the federal judges of the 9th circuit appeals court.....?
have gone over the top in ruling that felons behind bars in the State of Washington (i.e., you have to start somewhere but it would lead to all states in their jurisdiction at some point) have the right to vote. Hhhhmmm, something smells fishy here in that it sure would be easy to buy a vote from these characters. Of course I have nothing but disdain for federal judges since they live in la-la land. What do you think of some of this nations most violent criminals say like a Charles Manson being able to vote?

It upheld both the current wording of the Pledge of Allegiance (including "One nation under God") and the motto "In God We Trust" on US money.
While I certainly agree with the Court in both cases, Im stunned that the Nutty Ninth would hand down rulings that actually make sense and follow the Constitution. After all, they have a long tradition of being the first Court to discover new "rights" and otherwise act as an unelected legislature.

They posted the notice after homosexual groups used the citys e-mail, bulletin board, and written communications systems for promoting their views, including attacks on the bible and people of faith.
Dont you think that if the homosexual groups have the right to promote their viewpoints, the same right should be extended to the religious, family oriented? Isnt the right of free speech for all Americans?

It should be noted that the city has done nothing to discipline the other groups using the citys communication systems to put forth their political views. Fine with taking action againt personal/political action on any of the citys communications systems, but it should be taken against all perpetrators, not just those of a specific point of view.

SCOTUS vs. Federal 9TH CIRCUIT COURT OF APPEALS?
As you know, prop 8 is now being challenged in federal courts.
I read an article stating:
"Olson said he hoped the suit would wind up before the U.S. Supreme Court.
A favorable ruling there would allow gays and lesbians to get married in every state"
Does that imply that a favorable ruling at a lower court would NOT allow gays to get married in every state?
A favorable ruling at a lower court would only apply to California, not nationwide?
But a SCOTUS ruling would apply nationwide?
Is that true?
But both SCOTUS and a lower federal court deal with FEDERAL law.........as long as they are dealing with federal law, shouldnt it apply nationwide?
Answer: Federal courts only apply to states or part of states.
Federal appeals courts apply to circuits, which are groups of states
The U.S. Supreme Court applies to the nation as a whole.

BREAKING: Prop 8 Unconstitutional Says Ninth Circuit Court of ...
The defendant-intervenors have to decide whether to appeal to the US Supreme Court directly, or ask for a hearing before an 11 member (en banc) panel of the Ninth Circuit. Presumably giving up is not an option for them.

When a Circuit Court of Appeals makes a ruling, does it apply to just the original state or the entire region?
For instance, the US 9th circuit court of appeals ruled that Proposition 8 (California) violated the US Constitution. Therefore, it was illegal to deny gays the right to get married.
But heres my question. The 9th Circuits jurisdiction is over a whole bunch of states, not just California.

So if the 9th Circuits decision were to stand, would gay marriage be legal in all the states it has jurisdiction over (e.g., Montana, Alaska, California, etc.), or just California?
Answer: No, California's law does NOT become a Regional law because the Ninth Circus court ruled on it. It is still California's law.
The ninth Circus is the next step in the appeal process if the California State Supreme Court's ruling is unsatisfactory. It can still be appealed up to the Federal Supreme court, and when They rule, it also will NOT become a federal law.
If it WERE a federal law, the state court process would have been eliminated. Like all arguments over the constitutionality of Obama-care have been in federal courts.

Do you agree with this 9th Circuit Court ruling regarding your driveways and GPS devices?
Government agents can sneak onto your property in the middle of the night, put a GPS device on the bottom of your car and keep track of everywhere you go. This doesnt violate your Fourth Amendment rights, because you do not have any reasonable expectation of privacy in your own driveway - and no reasonable expectation that the government isnt tracking your movements.
That is the bizarre - and scary - rule that now applies in California and eight other Western states. The U.S. Court of Appeals for the Ninth Circuit, which covers this vast jurisdiction, recently decided the government can monitor you in this way virtually anytime it wants - with no need for a search warrant.
It is a dangerous decision - one that, as the dissenting judges warned, could turn America into the sort of totalitarian state imagined by George Orwell. It is particularly offensive because the judges added insult to injury with some shocking class bias: the little personal privacy that still exists, the court suggested, should belong mainly to the rich.
This case began in 2007, when Drug Enforcement Administration (DEA) agents decided to monitor Juan Pineda-Moreno, an Oregon resident who they suspected was growing marijuana. They snuck onto his property in the middle of the night and found his Jeep in his driveway, a few feet from his trailer home. Then they attached a GPS tracking device to the vehicles underside.
After Pineda-Moreno challenged the DEAs actions, a three-judge panel of the Ninth Circuit ruled in January that it was all perfectly legal. More disturbingly, a larger group of judges on the circuit, who were subsequently asked to reconsider the ruling, decided this month to let it stand.
